GENERAL RELEASE OF LIABILITY

I am voluntarily participating in outdoor volunteer work for the Queen Creek Botanical Gardens, a non-profit organization, (including, but not limited to, greeting guests, assisting guests at various activities, general site cleanup etc.) and I am participating in the work entirely at my own risk. I assume all related risks, both known or unknown to me, of my participation in this work, including travel to, from and during this work.

I acknowledge that this work may carry with it the potential for injury, illness, property loss and even death. The risks may include, but are not limited to, those caused by terrain, facilities, temperature, weather, lack of hydration, condition of participants, equipment, vehicular traffic and actions of others. 

I agree to be respectful and courteous in all of my interactions with patrons, staff, plants and property at all times on the grounds.

I agree to indemnify and hold harmless against any and all claims, suits or actions of any kind whatsoever for liability, damages, compensation or otherwise brought by me or anyone on my behalf, including attorney’s fees and any related costs, if litigation arises pursuant to any claims made by me or by anyone else acting on my behalf.

THEREFORE, under the terms of this Agreement and sufficiency of which are hereby acknowledged, I hereby release and forever discharge Queen Creek Botanical Gardens (25002 S 206th Rd Queen Creek, AZ 85142) (Hereinafter the “Releasees”) including their agents, employees, successors and assigns, and their respective heirs, personal representatives, affiliates, successors and assigns, and any and all persons, firms or corporations liable or who might be claimed to be liable, whether or not herein named, none of whom admit any liability to the undersigned, but all expressly denying liability, from any and all claims, demands, damages, actions, causes of action or suits of any kind or nature whatsoever, which I now have or may hereafter have, arising out of or in any way relating to any and all injuries and damages of any and every kind, to both person and property, and also any and all injuries and damages that may develop in the future, as a result of or in any way relating to the following: work performed on the Queen Creek Botanical Gardens site.

It is understood and agreed that this Agreement is made and received in full and complete settlement and satisfaction with the causes of action, claims, and demands mentioned herein; that this Release contains the entire Agreement between the parties; and that the terms of this Agreement are contractual and not merely a recital.

Furthermore, this Release shall be binding upon the undersigned, and his respective heirs, executors, administrators, personal representatives, successors, and assigns. 

This Release shall be subject to and governed by the laws of the State of Arizona. This Release has been read and fully understood by proof of the acknowledgment in the form above.
